Am I obliged to invoice electronically?

Since 2015, suppliers of goods or services to Public Administrations are obliged to issue and send electronic invoices to them.

eInvoice System

Electronic invoices are regulated by Royal Decree 1619/2012, of November 30, approving the Regulation governing invoicing obligations.

This is in accordance with Law 25/2013, of December 27, 2013, on the promotion of electronic invoicing and the creation of the accounting registry of invoices in the public sector.

For all levels of government, from general to local or regional, managing entities or universities, no other modality is accepted.

The obligatory nature

Between companies, it is not mandatory, and in order for a company or consumer to receive an electronic invoice from another company or consumer, it must first give its consent to be billed digitally. The request for consent must specify the form in which the electronic invoice will be received, as well as the option for the company to revoke such consent.

The advantages of electronic invoicing between companies or suppliers are many, in terms of the authenticity and integrity of the invoice and signature, and also in terms of payment and collection. Finally, there is a range of additional services for these e-invoices, such as invoice financing, factoring and advance payments.
